This Privacy Policy (this “Policy”) describes how Ace Machine Design, Inc. dba Beaker & Wrench (“Beaker & Wrench,” “we,” “our,” or “us”), collect, use, disclose, and safeguard your personal information. This Policy applies to individuals who access this website and any other websites that link to this Policy (collectively, the “Sites”).  However, where expressly indicated, other of our websites, products, and services may have their own privacy policies. This Policy, together with our Terms of Use, collectively govern your use of our Sites.

From time to time, we may change this Policy. If we do, we will post an amended version on this webpage. Please review this Policy periodically.

1. THE INFORMATION WE COLLECT

For the purpose of this Policy, personal information is any information about an identifiable individual. We collect the following types of personal information:

Information You Provide

When using our Sites or our services, you may provide us with your personal information when you do any of the following:

  • Create an Account. If you create an account with us, you may provide us with some or all of the following information: your full name, email address, mailing/billing address, phone number, birth date, and/or a password for future logins that you will create.
  • Subscribe to Our Blogs or Newsletters. If you subscribe to our newsletter, you will provide us with your email address.
  • Customer Service. If you contact our customer service department, you may need to provide us with additional information so that we can respond to your questions or concerns as completely and thoroughly as possible.
  • Purchases. When you make a purchase, you will provide us with some or all of the following information: your full name, email address, phone number, physical address, billing address and credit/debit card or gift card information or information pertaining to any other payment method authorized by Beaker & Wrench (collectively, “Payment Method”) through third-party credit card processing companies. We generally use third parties to process payments.
  • Track and Return Orders. If you check your order status or start a return, you will provide us with your order number and email address.
  • Apply for a Job. If you apply for a job, we will collect any information you provide in your application, including, but not limited to, work authorization information, visa status, desired salary, language proficiency, educational background, employment history, and references. You may also choose to voluntarily provide optional information such as race, gender, or whether you are disabled.
  • Business Information. We may collect personal information from business clients or vendors, including company name, physical address, phone number, email address, and credit card or banking information.

Information as You Navigate Our Sites

We automatically collect certain personal information through your use of the Sites, such as the following:

  • Usage Information. For example, the pages on the Sites you access, the frequency of access, and what you click on while on the Sites.
  • Device Information. For example, hardware model, operating system, application version number, and browser.
  • Mobile Device Information. Aggregated information about whether the Sites are accessed via a mobile device or tablet, the device type, and the carrier.
  • Location Information. Location information from visitors on a city-regional basis.

Additionally, we may derive information or draw inferences about you based on the other types of personal data we collect. For example, we may infer your location based on your IP address or that you are interested in purchasing particular products based on your browsing behavior on our Sites.

Beaker & Wrench reserves the right to transfer and/or sell aggregate or group data about users on our Sites for lawful purposes. Aggregate or group data is data that describes the demographics, usage and other characteristics of our users as a group, without disclosing personally identifiable information.

Third Party Information

If you submit any personal information about another individual to us, you are responsible for making sure you have the authority to do so and to allow us to use their personal information in accordance with this Policy.

Credit and/or Debit Card Transactions

Beaker & Wrench utilizes third-party service providers to provide credit and debit card payment processing services.  If you choose to purchase merchandise, the third party payment processor associated with the Payment Method selected by you (“Third Party Processor”) may collect the information you provide in connection with such purchase.  The Third Party Processors may collect some or all of the following information by and through the payment registration form completed by you: name, billing address, e-mail address, telephone number, and credit card and/or debit card information (collectively, “Third Party Processor Data”). The Third Party Processors use the Third Party Processor Data solely to process the applicable transaction(s) and as otherwise permitted by their respective privacy policies. You may learn more about how the Third Party Processors collect and process data, and opt-out from some or all such uses, by and through their respective privacy policies. Below is a list of Third Party Processors that we currently use or may use in the future and links to their respective privacy policies.

Beaker & Wrench requires that its Third Party Processors have in place privacy policies and practices consistent with this Policy; provided, however, that we cannot guarantee the privacy practices of our Third Party Processors.

2. HOW WE USE YOUR INFORMATION

We may use the personal information we collect to improve our Sites and to protect our legal rights. In addition, we may use the personal information we collect to:

  • Process your account registration.
  • Process and fulfill your order, including sending you emails to confirm your order status and shipment, and to provide other related communications.
  • Send you our blogs or newsletters, if you have subscribed to the same.
  • Identify your preferences to customize our communications and marketing.
  • Manage and record your settings, consents, communications and opt-out choices.
  • Review your job application.
  • Communicate with you about our Sites or to inform you of any changes to our Sites.
  • Operate and improve our Sites, including to analyze visits to our Sites and learn about our visitors so we can operate our Sites and improve our products and services and deliver the best user experience.
  • Create audiences for our advertisements, target our advertisements, and generate reports about the performance of our advertisements.
  • Communicate with you, including responding to your inquiries.
  • Comply with the law and maintain the integrity and security of our Sites.
  • Defend our legal rights and the rights of others.
  • Investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or violations of our Terms of Use and to otherwise fulfill our legal obligations.
  • Fulfill any other purposes for which you provide your information, or any other purpose we deem necessary or appropriate.

By submitting your personal information by and through our Sites, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR §310 et seq.), as amended from time to time (the “Rule”) and applicable state do-not-call regulations.  As such, notwithstanding that your telephone number may be listed on the Federal Trade Commission’s Do-Not-Call List, and/or on applicable state do-not-call lists, we retain the right to contact you via telemarketing in accordance with the Rule and applicable state do-not-call regulations.

Where you provide “prior express consent” within the meaning of the Telephone Consumer Protection Act (47 USC § 227), and its implementing regulations adopted by the Federal Communications Commission (47 CFR § 64.1200), as amended from time-to-time (“TCPA”), you consent to receive, from Beaker & Wrench, telephone calls (including text alerts via SMS text messages) delivered via automated technology, to the telephone number(s) that you provided.  Please note that you are not required to provide this consent in order to obtain access to our Sites, and your consent simply allows Beaker & Wrench to contact you via these means.  Please be advised that by agreeing to this Policy, you are obligated to immediately inform us if and when the telephone number that you have previously provided to us changes.  Without limiting the foregoing, if you: (A) have your telephone number reassigned to another person or entity; (B) give up your telephone number so that it is no longer used by you; (C) port your telephone number to a landline or vice versa; or (D) otherwise stop using that telephone number for any reason (collectively “Phone Number Change”), you agree that you shall promptly notify Beaker & Wrench of the Phone Number Change via e-mail at: privacy@beakerandwrench.com.

You hereby consent to the disclosure of any record or communication to any third-party when we, in our sole discretion, determine the disclosure to be required by applicable law, including sharing your e-mail address with third-parties for suppression purposes in compliance with the CAN-SPAM Act of 2003, as amended from time to time, and other e-mail marketing laws.  Users should also be aware that courts of equity, such as U.S. Bankruptcy Courts, might have the authority under certain circumstances to permit personal information to be shared or transferred to third-parties without permission.

3. SHARING YOUR INFORMATION WITH THIRD PARTIES

We may share the personal information that we collect about you in the following ways:

  • We engage service providers to perform services in connection with the operation of our business. We may share personal information with service providers to the extent necessary for them to provide services to you or us that are aligned with the purposes outlined above. Examples of these services include payment processing and authorization, text messaging services, fraud protection and credit risk reduction, product customization, order fulfillment and shipping, marketing and promotional material distribution, website evaluation, data analysis and, where applicable, data cleansing.
  • In proceeding with your online order, you agree that any information associated with the order, such as the delivery name and address (if different from yours), will be processed using service providers.
  • Personal information collected through our Sites may be shared between our brands and affiliates, including future affiliates that are owned or operated by Beaker & Wrench
  • We may release personal information if we believe in good faith that: (i) the law or legal process requires it; (ii) we have received a valid administrative request from a law enforcement agency, including a subpoena; provided, however, that, where permitted by applicable law, we shall provide you with e-mail notice, and opportunity to challenge the subpoena, prior to disclosure of any personal information pursuant to a subpoena; (iii) such release is necessary or appropriate (in our sole discretion) to protect the rights, property, or safety of Beaker & Wrench, or any of our respective affiliates, service providers, or customers, or (iv) as Beaker & Wrench deems necessary to resolve disputes, troubleshoot problems, prevent fraud and otherwise enforce the Terms of Use.
  • We may also share your information with your consent or as otherwise disclosed at the time of data collection or sharing.
  • As with any business, it is possible that as ours develops, we might go through a business transition, such as a merger, acquisition by another company, or the sale of all or a portion of our assets, or buying online stores or other assets, including at bankruptcy. In such transactions, information about customers, including your personal information, will likely be transferred. Please note that if Beaker & Wrench is involved in a bankruptcy proceeding, merger, acquisition or sale of all or a portion of its assets, you will be notified via e-mail and/or a prominent notice on our Sites of any change in ownership or uses of your personal information, as well as any choices that you may have regarding your personal information.
  • Our Sites may allow you to provide comments in various sections of our Sites, such as in product reviews. Please be aware that the information you post in these areas may be available to visitors of our Sites and to the general public. To the fullest extent allowed under applicable law, we do not monitor such content and are not responsible for material posted by you or others in these public forums.
  • We sell our products and services. This means that your personal information may be transferred in jurisdictions that have less restrictive privacy laws than your country, province, or state of residence, in which case we will ensure, through contractual means or otherwise, that it will receive an adequate protection in compliance with generally accepted data protection principles. We take steps to process personal information according to the provisions of this Policy and the requirements of applicable law.
  • We may use non-personal information to analyze visits to the Sites and learn about the interests of our visitors in aggregate and to better understand your interests and needs, so we can improve our products and services and deliver to you the type of content, features and promotions in which you are most interested. We may share non-personal, aggregate data with our marketing partners or other third parties for research and marketing purposes. On occasion, we may combine information that we received on or through the Sites with information obtained from other sources and outside records to enable us to update and correct the information contained in our database.

Like many other companies, Beaker & Wrench uses cookies and other tracking technologies (such as pixels and web beacons) (collectively, “Cookies”) when you visit our Sites, and use the services provided through our Sites. “Cookies” are small files of information that are stored by your web browser software on your computer hard drive, mobile or other devices (e.g., smartphones or tablets).

Strictly Necessary Cookies

These Cookies are necessary for our Sites to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. Performance Cookies

5. DIGITAL ADVERTISING & ANALYTICS/INTEREST-BASED ADS

We may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on behalf of us and others on our Sites and non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of our Sites and other sites or apps over time, including information about relationships among different browsers and devices (“Interest-based Advertising”).

You may choose whether to receive some Interest-based Advertising by submitting opt outs. Some Advertising Providers may participate in the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. Advertising Providers may use data collected in connection with our advertising campaigns for the following purposes:

  • For measurement and insight reporting (to produce and provide us with reports measuring the impact and performance of our advertising campaigns).
  • To produce benchmarking reports to share with their other customers, but such benchmarking reports will not identify you.
  • To target our ad campaigns to specific groups of individuals having particular characteristics.
  • To improve and optimize advertising services (for example, to support the objectives of our ad campaigns, improve the effectiveness of their own advertising services and determine the relevance of ads to individuals).
  • To personalize ads that the Advertising Providers show, including to enhance user profiles with inferred interests.
  • For their internal purposes, including (i) to promote and ensure the safety and security on and of their products and services; (ii) to detect and prevent malicious, deceptive, fraudulent, invalid or illegal activity; (iii) for research and development purposes; and (iv) to maintain the integrity of and to improve their products and services.
  • To combine it with other data collected by Advertising Providers in order to provide greater insights in respect of our advertisements.

We may also work with service providers that collect data about your use of our Sites and other sites or apps over time for non-advertising purposes subject to their privacy policies.

We may use web analytics tools to enhance user experience by optimizing the efficiency, design, and quality of our Sites. Our analytics tools use Cookies and similar technologies to collect and analyze information related to user behavioral metrics on our Sites, such as mouse movements, clicks, user inputs, scrolling, access time, visit duration, pages viewed, IP address (including approximate location), operating system, and page reloading. These tools provide insight into what works and what doesn’t work for users of our Sites and they allow us to, for example, identify and repair technical errors such as broken links that impair the functionality of our Sites. The web analytics tools also help us reconstruct the user experience to better understand, for example, where users may be encountering frustration or impediments to using our Sites.

We may use a website analytics tool that provides session replay, heatmaps, funnels, form analytics, feedback campaigns, and similar features/functionality. This session replay software may record your clicks, mouse movements, scrolling, form fills (keystrokes) in non-excluded fields, pages visited and content, time on site, browser, operating system, device type (desktop/tablet/phone), screen resolution, visitor type (first time/returning), anonymized IP address, location (city/country), language, and similar metadata. This software does not collect information on pages where it is not installed, nor does it track or collect information outside your web browser.  We may use this web-based analytics software because it gives us a tool to track the online behavior of visitors while on our Sites and lets us replay visitors’ actions. This tool gives us the opportunity to make our Sites better and, in turn, provide you with an enhanced online experience as well. Thanks to this tool, we are able to gain insight on how you and other visitors use our Sites. Information about these small choices and interactions are of paramount value to us, as they can easily make your experience better and more intuitive and, more importantly, allow us to provide you with a more seamless, customer-friendly e-shopping experience while on the Sites.

We may use pixel tags (also known as web beacons and clear GIFs) to, among other things, track the actions of users of our services (including email recipients), measure the success of our marketing campaigns, and compile statistics about usage of the services and response rates. Our Advertising Providers may use pixel tags to collect information for the purposes described above.

6. THIRD-PARTY LINKS & PLUG-INS

The Sites may provide links to third-party websites or apps, including our social media pages. We do not control the privacy practices of those websites or apps, and they are not covered by this Policy. You should review the privacy policies of other websites or apps that you use to learn about their data practices.

The Sites may also include integrated social media tools or “plug-ins,” such as social networking tools offered by third parties. If you use these tools to share information or you otherwise interact with social media features on the Sites, those social media companies may collect information about you and may use and share such information in accordance with their own policies, including by sharing such information with us or the general public. Your interactions with third-party social media companies and the use of their features are governed by the privacy policies of the companies that provide those features. We encourage you to read the privacy policies for any social media accounts you create and use.

7. YOUR STATE PRIVACY RIGHTS

Depending on the state in which you reside, you may have certain privacy rights regarding your personal data. Please review the sections below if you are a California, Colorado, Connecticut, Nevada, Utah or Virginia resident. For other state residents, your privacy rights may include (if applicable):

  • The right to confirm whether or not we are processing your personal data and to access such personal data.
  • The right to obtain a copy of your personal data that we collected from and/or about you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another controller without hindrance, where the processing is carried out by automated means.
  • The right to delete personal data that we collected from and/or about you, subject to certain exceptions.
  • The right to correct inaccurate personal data that we maintain about you, subject to certain exceptions.
  • The right, if applicable, to opt out of the processing of your personal data for purposes of (a) targeted advertising; (b) the “sale” of your personal data (as that term is defined by applicable law); and (c) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
  • If we are required by applicable law to obtain your consent to process sensitive personal data, the right to withdraw your consent.
  • The right not to receive discriminatory treatment by us for the exercise of your privacy rights.

We use Cookies and other tracking technologies to display advertisements about our products to you on nonaffiliated websites, applications, and online services. This is “targeted advertising” under applicable privacy laws. When we engage in those activities, we sell personal data (i.e., information from Cookies) to third-party advertisers and analytics companies. We may transfer your personal data (e.g., name, email address, and year of birth) to joint marketing partners. Under applicable privacy laws this may be considered a “sale” of personal data to third parties. We do not use personal data for profiling in furtherance of decisions that produce legal or similarly significant effects concerning individuals.

If legally required, we will comply with your request upon verification of your identity and, to the extent applicable, the identity of the individual on whose behalf you are making such request. To do so, we will ask you to verify data points based on information we have in our records. INDIVIDUAL STATES

This section contains additional information relevant to residents of certain US states that have their own data privacy laws and regulations, and associated rights.

CALIFORNIA RESIDENTS

This notice to California residents is provided under California law. It provides our “Notice at Collection,” provides certain mandated disclosures about our treatment of California residents’ information, both online and offline, explains your privacy rights, and provides our “Notice of Financial Incentives.”

NOTICE AT COLLECTION

We may collect the following categories of personal information (as defined in the California Consumer Privacy Act (CCPA) and the California Customer Records statute), including sensitive personal information (as defined in the CCPA):

  • Identifiers, such as name, email address, username and password, postal address, telephone number, signature, government-issued identifier, IP address, and other similar identifiers.
  • Characteristics of protected classifications and demographic information, such as gender, age, race, disability status, sexual orientation, gender identity, military/veteran status, marital status, national origin, and medical information.
  • Commercial information, including information about your interests and consuming history or tendencies, such as products or services considered; transaction information when you request information, contact customer service, or purchase, return, request or exchange a product or service, including payment card information or other financial information; information provided in response to surveys or other research conducted on our behalf; and information you provide in public forums.
  • Internet or other electronic network activity information, including information regarding your interactions with us online and information we obtain from third parties about use of our applications on third-party platforms or devices.
  • Geolocation data, including precise or approximate location information provided by a mobile device or other device or product interacting with or detected by our sites, applications, or physical properties, where we are permitted by law to process this information.
  • Audio, electronic, visual, or similar information, including telephone call recordings, other voice recordings, and still or video images captured by cameras or readers on or around our physical properties.
  • Inferences based on the above.

We collect this information so that we can best serve you, including to fulfill your requests and to share offers or information that we think you may be interested in. As further described in How Do We Use Your Information section in our Policy, we generally collect and use the above-listed categories of personal information to provide and manage our sites, applications, products, and services, and for other business or commercial purposes, such as advertising, marketing, and to improve our products and services.

Certain data collection on our sites and applications by third parties for purposes of interest-based advertising and social media tools may be a “sale” or “sharing” under California privacy law. As defined by California law, we “sold” or “shared” certain data elements within the following categories of personal information: identifiers, demographic information, commercial information, Internet or other electronic network activity information, approximate geolocation, and inferences drawn from the above.

We retain each category of personal information that we collect for as long as necessary to fulfill the purposes described in our Policy, including to satisfy legal or reporting requirements. What this means in practice will vary for different types of information, but the criteria assessed in the data retention analysis take into account ongoing business or legal needs for the information, for example in relation to tax, health and safety, and potential or actual disputes or investigations.

We endeavor to safeguard and protect your personal information. Access to your personal information is strictly limited, and we take reasonable measures to ensure that your personal information is not accessible to the public. All of your personal information is restricted in our offices, as well as the offices of our third party service providers. Only employees or third party agents who need personal information to perform a specific job are granted access to personal information. Our employees are dedicated to ensuring the security and privacy of all personal information. Employees not adhering to our firm policies are subject to disciplinary action. The servers that we store personal information on are kept in a secure physical environment. We also have security measures in place to protect the loss, misuse and alteration of personal information under our control.

In order to protect the payment information you provide to us, including your credit card number, expiration date, security code, and billing address, we use 2048-bit Secure Sockets Layer (SSL) technology. SSL technology encrypts your information so that it cannot be recognized or decoded in cyberspace. Your computer will begin operating in secure mode once you enter our checkout page. You can confirm that SSL is active by looking in the lower left hand corner of your browser, where you will see either a closed lock or an unbroken key (depending on your browser type). Additionally, the URL line of your browser will change from “http” to “https” when the SSL technology is operating.
